ELD Mandate Begins December 18th

The day is quickly approaching for drivers to begin using electronic logging devices (ELD’s) as required by the FMCSA. ELD’s will replace paper logs for recording drivers’ Hours of Service (HOS), ensuring improved efficiency, better recording accuracy, and greater compliance with federal transportation rules.

In preparation for the big day, here are a few things to remember:

• An ELD is preferred over AOBRD’s which can be altered. Drivers using AOBRD’s may be subject to more detailed roadside audits.
  
  
• Drivers are protected from harassment and coercion by Part 392.3. Drivers can file civil suits against shippers, receivers, or individuals who have forced them to move trucks after the driver’s hours have been exhausted. Some suits have resulted in six figure settlements.
  
  
• Truckers should continue to have paper logs handy in the event the ELD malfunctions. Hours can be logged on paper for 8 days. On the 9th day, the ELD must be operational, and the truck cannot be moved (even to go to the garage) until the ELD is recording properly.
  
  
• Choose a reputable ELD vendor that is FMCSA registered and offers 24/7 support.
  
  
• Drivers not in compliance after the 18th can be given a citation and fined for not having a working ELD. However, scores will not be affected nor out of service declared until April 1, or March 18 if you transport cattle.
  
  
• Planning routes is essential so that drivers know where to stop when going off duty. Drivers may benefit from the increased accuracy of ELDs by gaining 30-60 minutes more time compared with paper logs, which use quarter hour increments.
  
  
• If you have purchased ELDs but have not received or installed them by the 18th, drivers should use paper logs and carry evidence that the ELD is ordered.
  
  
• Drivers must understand how to properly use their ELD and be prepared to demonstrate correct operation to field agents during spot checks.
